Beware of Scam “Forensic” Loan Auditors/Companies

Ok, here we go go again… now the scams have hit the loan auditing industry. Most of these fakers are ex-mortgage brokers who didn’t make it in the mortgage industry and are now looking for a new way to make money. There are a few good auditors out there who have really put in the time, effort and research to actually know the laws and know how to properly state the elements of these violations in a manner that can actually help a homeowner in a foreclosure matter (and can help an attorney bring these violations as affirmative defenses or counterclaims in a foreclosure case).

 TILA or supposed “Forensic” Audits that use standardized check-off lists without providing a mathematical determination of the TILA Disclosure Statement and amounts are NOT Forensic Audits.  A check-off list  or automated/software-driven TILA Audit describing potential violations as “Serious,” or “Moderate” is incompetent and useless.  A Forensic TILA Audit must provide accurate TILA; Regulation Z citations, case law precendent, as well as actual computation of all settlement service fees properly allocated in the TILA Disclosure Statement or the Audit will NOT withstand scrutiny by legal authorities.  Do not be fooled by imitations using standardized check-off lists.

There is absolutely nothing “forensic” about plugging loan data into some software and having it spit out a report. But that is exactly what most of these fakers are doing and they are charging anywhere from $395 to $995 based on what I have seen so far.

If the loan audit will NOT stand up to legal scrutiny then you have wasted your money and someone has scammed you into believing you were paying for something that would help you. Why would  you pay for a loan audit that would not stand up to legal scrutiny?

The software driven report serves a limited purpose and I use a popular banking compliance software for my audits as well but this software-driven report is only a small piece of my actual audit and findings report. A true forensic auditor examines every document relevant to the loan and looks at signatures, dates, parties on the documents, who provided those disclosures or documents and also obtains the story from the client because every loan is a story. It involved people and usually quite a bit of communication between the borrower and the indispensable parties to the transaction.

I have myself setup for Google Alerts on a number of search terms so I go to these other websites pretty frequently. I also get clients who have dealt with some of these fraudsters and now want my help to clean up the mess and the wasted money. Hopefully this post will cause those who read it to really do some good checking before they part with hard-earned money.

Bottom line is to make sure you follow your gut. Do your homework, ask questions, ask for references. A good auditor will most likely have attorneys they work for and consult for.

    Does anyone know about Nationwide Loan Auditing? They want $3500 for a Forensic Audit. After a soft audit, they are assuring me that I have a strong case against the Aurora Loan Services, who took over the loan from the original lender Homecomings Financial. They are very quick to answer questions and are rushing me toward the fee and the full audit with promises of easy success. It feels like a scam. I've been passed off twice to supposed higher ups now. I am NOT recommending them as of yet.

    The do audits and offer an assessment for $335. once reviewed they will report whether or not they will accept your case and provide guidance on which service(s) to order. When you upgrade to a Stage One, nearly all of what you paid for the Assessment will be deducted from the cost of the regular package price of whatever you need. The first package go for $346, then if you need to go to stage 2 they sell it for $692. They seem to be on the up and up. Has anyone used their sevices?

    I have used a Forensic Audit in Denver and have had a TERRIBLE time thru the process!
    Beware of ALL of them! Go with someone who explains EVERYTHING to you first and is willing to show you their work!

    i was recently contacted by mailer by a company defend your mortgage llc i believe they are on NJ anyone have had any dealings with these people they are sending a auditor to evaluate my mortage papers then if i decided to hire them it would cost 500 down and payment of 750 every 2 weeks for a total of 3000 i havent set anything up trying to research them first

    I have been told that anyone who wants any money before they perform a service is to be avoided. Apparently most of the people here are in the same boat we are-somewhere in the Foreclosure process, and can't figure out what to do to stop it, and being warned that most of the so called forensic auditors are scams. What do you do?

    i hired this company (Law office of James Caplan CAPLAW) to do a loan modification on 1/10/11 with 3 installment payments of $833.00, but two weeks later i found out this company is the same company as the law office of james cioffi which is known for scamming customers all on the internet. i should of got a red flag from the new bbb membership that they send you to prove they are BBB certified and they just changed the name to (CAPLAW P.A.). 3 weeks later I told the company i want to terminate there services and want my $833.00 payment back and they said no refund. what i dont understand is why dont i get a refund back when they didnt do anything….Please dont use this company because you will not get a loan mod plus you will lose your $2500 retainer fee

    Has anyone done business with American Forensic Loan Auditors? I guess business is the wrong term to use. Unfortunately for me I have. To date they have done nothing except gather documents from me. When I ask for updates regarding progress with IndyMac, there standard reply is, "we have spoken with your lender and they are actively reviewing your loan, no documents are needed at this time. We will update your situation in 2-3 weeks." The bank on the other hand has requested documents from me for the past 6 months and according to them will make a decision by March 14, 2011. The last three attempts to contact this company has resulted in 0 responses. Two phone calls have also been totally ignored. Anyone out there in the same situation I am in please contact me as I am taking legal action and would like to include as many as possible to force these people into court or at least to answer in some fashion.

    American Forensic Loan Auditors (AKA B. Diego Hellewell) is a scam. The only way to get a loan modification is to call your mortgage company and work with them directly. The best part about this approach is it's FREE!

    I have been working with Truth in Lending Auditors, LLC Cheyenne, WY for over a year now they are a scam company. They never followed up on collection of documents and never negotiated when they needed to they forgot. Don't use them Please!

    Has anyone heard of Bella Homes, LLC based out of Atlanta, GA for forensic mortgage audits. They offered to do a forensic audit of my mortgage, lease my home to me for 5-7 years and charge me $4,000 closing costs upfront. This sounds like a scam?

    MODS 101: I have a friend who’s been trying for two years to get a loan modification with BOA. Needless to say, its been a nightmare and hasnt gone anywhere. Out of desperation, he has signed up with MODS 101 Inc out of FL. They are a forensic auditing company. He has sent them two payments upfront totaling about $900. In my heart I know its a scam but he feels so hopeful. Has anyone heard of them?? They have a website but it looks like a lot of BS wrapped in a pretty package to me. Any info is helpful. Thank you!

    Has anyone been ripped off by a company "Nationwide Loan Auditing" out of California? They took $3000.00 from me to provide a loan audit and didn't follow thru. They still have a website up and running yet they didn't follow thru and owe me back a Guaritee of $300.00 +. Owners name is jlamar@nationwidela.com (jarred La Mar). Beware!!!!!!!!!

    what about Twin Builders Foundation Corporation in California? Are they legitimate? They were asking for $1,500 initial payment and $$5,000 for the final transactions. The person who did a presentation to us last week (Hawaii) said this company can reduce or wipe out the mortgage and still have a settlement. The lawyer gets 40% of the settlement. Do you think this is a legitimate company?

      If something seems too good to be true, it usually is. BEWARE! Do your research. Investigate the people behind the company and the lawyers. Especially the lawyers. It’s very easy. If the lawyer or lawyers have any history of fraud or punishment from the bar because of ‘bad’ behavior, be especially aware of what you are getting into.

      Again, if something seems too good to be true AND they ask for money, especially in the thousands of dollars, up front, be cautious.

      Nowadays it’s easy to investigate a company. So DO it.

    I have been trying to find out about this company. There does not seem to be much negative information, however they are headquartered in Nevada, and their services cannot be used there (according to there website). We are wary of all these sites, as we have applied and been denied the HAMP. It seems our previous attorney did collect some information, but the government and the attorney actually left the final decision to BofA, and they said no. I want to pursue this again, but we simply cannot afford another $2500-$5000 for legal advise. BofA turned us down due to unsteady employment for a year. However, we are working again (albeit at a fraction of my prior paycheck). In 30 yrs, we have missed 1 house payment over 4 mortgages, and we would like to bring our payment in line with our current salary. if you uncover any further information about these guys, please post it.

      I got the same call from nationwide financial consulting. Any company that wants money up front I would beware of. I have done some researching and most of these forensic audit companies are scams.

    I was recently contacted by PCI, a forensic home loan company based in Atlanta GA. They are willing to work with me for a fee of $1500.00. $500.00 retainer and the remainder in installments. Do you know anything about this company? Are they reputable?

    we were just contacted by Consumer Advocates Group out of LA, They want $2000 up fron(or in installments) to do a forensic loan audit with a promise of getting us into a fixed rate mortgage reducing our monthly paymrents by 1/3. Are thet legit? most of what I am reading says not.

    NATIONWIDE FINANCIAL CONSULTING in California has contacted us for the 'Re-Construction" of our mortgage, guaranteeing to be completed in 45 days; but to be paid in full up front. Sounds like another scam to me. they claim a money back full refund if they do noy perform. in additional they have 'bond money' available they claim, thus reducing our fee to $500. split into 2 payment. however, reducing the fee further if you pay it all up front at once to $400.

    Who are these people? This one expert claims 212success against Wells Fargo, and 356 against Bank of America in FL in the past year.

    With all the scam out there we do not want to lose more money and find some derogatory incident involving them.

    Information, please.
