I will comment that I am in the middle of this exact process. Rescinded my loan, completely right, before the deadline. My attorney now says that I am out in the cold on the rescission because since my lenders didn't respond (they rarely do) that my resulting demand for their compliance must ALSO be inside of the three year statute… WHAT???? I said, how is that possible? I have to give them 20 days to respond before I can bring suit?? She said, "I know it doesn't seem fair, but we are stuck with it." and sited some cases… I am shattered. Thoughts?
